Privacy Policy for Kukulala

1. Introduction

Welcome to Kukulala! This Privacy Policy applies to the Kukulala iOS application (the “App”), operated by coralworks innovations Inc. ("we," "us," or "our"). This policy describes how we collect, use, and share information about you when you use our App.

Your privacy is critically important to us. In short, we collect your story ideas and personalization data (like photos) to create your books using advanced AI partners. Your creations are stored securely in your personal iCloud space, giving you control over your data. We take your privacy, and especially your children's privacy, very seriously.

By using our App, you agree to the collection and use of information in accordance with this policy.

2. Information We Collect

We collect information in a few different ways to provide and improve our service to you.

a. Information You Provide Directly

• Account & Subscription Data: When you create an account, we collect your name and email address. When you subscribe to our premium service, payments are processed securely by Apple's App Store. We do not receive, process, or store your credit card or payment information.
• Story Creation Content: To create your personalized storybooks, we collect the content you provide, which includes:
  • Text prompts and descriptions for your story.
  • Voice recordings, which are used for our voice input (dictation) feature.
  • Photographs and images you upload to personalize characters in your stories.

b. Data Stored on Our Behalf (Apple CloudKit) All the storybooks you generate and their associated content are stored directly in your private Apple CloudKit database, which is linked to your personal iCloud account. This means your creations reside within your own secure cloud infrastructure provided by Apple. While we require access to this data to operate the App and display your library, you have ultimate control over its storage and deletion.

c. Information Collected Automatically

• Usage Data & Device Information: We automatically collect anonymized information about how you interact with our App, such as the features you use, the styles you select, and the duration of your sessions. We also collect standard device information, like your device type and operating system version, for analytics and to help us identify and fix bugs.

3. How We Use Your Information

We use the information we collect for the following purposes:

• To Provide and Personalize the Service: Our core function is to bring your stories to life. We use your text prompts, photos, and descriptions as direct inputs for our third-party AI models to generate story text and illustrations. We use voice recordings to transcribe text for prompts and use story text to generate audio narration for our read-aloud feature.
• To Improve Our App: We use anonymized and aggregated usage data to understand how our users engage with Kukulala, allowing us to improve the user experience, develop new features, and fix bugs.
• To Enforce Acceptable Use: To ensure a safe experience, your text prompts may be automatically scanned by our AI partners to moderate against the creation of prohibited or harmful content, in line with their safety policies.
• AI Training Policy: We are committed to protecting your creative privacy. We do not use your personal content, such as your photos, voice recordings, or the text of your stories, to train our or our partners' AI models.
• To Communicate With You: We use your email address for account management, to provide customer support, and to send you important service-related announcements.

4. How We Share Your Information

We do not sell your personal information. We only share it with trusted partners under the following circumstances:

a. With Third-Party AI Service Providers To function, Kukulala shares your content with third-party service providers who perform specific tasks on our behalf. This includes:

• Text Generation Providers (to write the story)
• Image Generation Providers (to create illustrations)
• Speech-to-Text Providers (to process voice prompts)
• Text-to-Speech Providers (to create the read-aloud audio)

b. With Cloud Infrastructure Providers (Apple) As mentioned, your generated content is stored in your private CloudKit database, which is managed by Apple. Apple’s privacy policy governs their handling of this data.

c. User-Initiated Sharing Our App allows you to share your created books using the standard iOS sharing features. When you choose to share content with other apps, services, or people (e.g., via iMessage, email, or social media), that shared content is no longer governed by this Privacy Policy. You are responsible for what you share and who you share it with.

d. For Legal and Safety Reasons We may disclose your information if we believe it is necessary to comply with a law, regulation, legal process, or governmental request; to protect the safety of any person; to address fraud, security, or technical issues; or to protect our rights or property.

e. Business Transfers In the event of a merger, acquisition, or sale of assets, your information may be transferred as a part of that transaction.

5. Children's Privacy

Kukulala is designed for adults—parents, grandparents, and educators—to create content for children. We comply with the Children’s Online Privacy Protection Act (COPPA) and other relevant regulations. We do not knowingly collect personal information directly from children under the age of 13 (or 16 in the European Union) without verifiable parental consent. By uploading a photo to our App, you confirm that you are the parent or legal guardian of the child in the photo, or that you have obtained the necessary consent from the parent or legal guardian to use the photo within the App for character creation.

6. Data Retention and Security

• Retention Policy:
  • Your created books are stored in your private CloudKit database and are retained as long as you choose to keep them there. We do not automatically delete your books.
  • If your subscription lapses, you will retain access to your previously created books but will not be able to create new ones.
  • The deletion of your books and associated content is managed by you through your device's iCloud settings for the Kukulala app. If you delete the app's data from CloudKit, it is permanently removed and cannot be recovered by us.
• Security: We are committed to protecting your data. We leverage the robust security measures of Apple's CloudKit infrastructure, which includes encryption of data both in transit and at rest.

7. Your Rights and Choices

You have rights concerning your personal information.

• Access and Correction: You can review and edit your account information (name and email) within the App's settings.
• Deletion: You have the right to delete your generated content. This is done by managing the Kukulala App's data within your device's iCloud settings. Deleting the App's data from CloudKit will permanently erase all storybooks you have created.

8. International Data Transfers

coralworks innovations Inc. is based in Canada. Your information may be processed by our third-party AI partners in other countries, including the United States. We ensure that legal mechanisms, such as standard contractual clauses, are in place to protect your data when it is transferred internationally.

9. Governing Law

This Privacy Policy and any disputes arising from it will be governed by the laws of the province of Ontario and the federal laws of Canada applicable therein.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any changes by posting the new policy within the App and updating the "Effective Date" at the top. We encourage you to review this policy periodically.

Welcome to Kukulala! These Terms of Use ("Terms") govern your access to and use of the Kukulala mobile application (the "App") and any related services (collectively, the "Service") provided by Coralworks Innovations Inc., a federally incorporated Canadian corporation ("we," "us," or "our").

Please read these Terms carefully. By creating an account, accessing, or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

1. The Service

Kukulala is an AI-powered application that allows users ("Users," "you") to create, read, and share personalized, illustrated digital storybooks ("Generated Content").

• Free Service: As a user of our free service, you may browse, read, and listen to the curated books available in our Public Library. The creation of personalized books is not included in the free service.
• Premium Subscription: By purchasing a subscription, you gain the ability to create your own Generated Content based on your text or voice prompts, uploaded photos, and other inputs ("User Inputs"), subject to the limitations of your chosen subscription plan. If your subscription lapses, you will retain access to your previously Generated Content in a read-only capacity but will be unable to create new content until you re-subscribe.

2. Eligibility

You must be at least 18 years of age or the age of legal majority in your jurisdiction to create an account and purchase a subscription. If you are a parent or legal guardian, you may permit a minor to use the Service under your direct supervision, provided that you remain responsible for their use of the Service and their compliance with these Terms.

3. Subscriptions and Payments

• Billing and Page Credits: Subscriptions are available on a monthly or other periodic basis as specified in the App. Your subscription grants you a specific number of "pages" that you can use to generate content each billing cycle. For example, creating a 20-page book will deduct 20 pages from your monthly allowance.
• Use It or Lose It Policy: Page credits are valid only for the duration of the billing cycle in which they were granted. Unused pages do not roll over to the next billing cycle. At the beginning of each new cycle, your page count will reset to the amount specified in your subscription plan.
• Payments and Renewal: All payments are processed through the Apple App Store and are subject to its terms and conditions. Your subscription will automatically renew at the end of each billing period unless you cancel it through your App Store account settings before the renewal date.
• Cancellations and Refunds: You may cancel your subscription at any time. All purchases are final and non-refundable, except where required by law.

4. User Content and Intellectual Property

This section outlines the ownership and rights related to the content in our Service.

• Your User Inputs: You retain full ownership of the original content you provide to the Service, including your text prompts, voice recordings, and any photos you upload.
• Our License to Your Inputs: To operate the Service, you grant us a limited, worldwide, non-exclusive, royalty-free license to use, host, store, and modify your User Inputs solely for the purpose of providing and maintaining the Service for you (e.g., to generate your storybook and display it in your library).
• Ownership of Generated Content: We grant you a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, and share the Generated Content you create for personal, non-commercial purposes only.
• Sharing: You may share your Generated Content using the native iOS sharing functionality. However, because this may allow you to export content outside of the App (e.g., as an image or file), you are solely responsible for ensuring that any use of that exported content complies with the personal, non-commercial license granted in these Terms. You may not sell, license, or use your Generated Content for any commercial purpose whatsoever without our express prior written consent.
• AI Model Training: We are committed to your privacy. Your personal User Inputs, such as uploaded photos and voice recordings, will not be used to train or improve our third-party AI models.

5. Content Moderation and Disclaimers

• Automated Moderation: The Service utilizes automated moderation tools provided by our third-party AI service providers to filter User Inputs and prevent the generation of prohibited content. You acknowledge that these automated systems are not perfect and may be overly sensitive or fail to identify certain types of content.
• Consumption of Page Credits: A generation request that is successfully processed and results in a book will consume page credits from your subscription allowance. This is true regardless of your satisfaction with the final Generated Content. No refunds for page credits will be issued if you disagree with, dislike, or find the Generated Content to be inappropriate. You may archive or delete any book you create.
• Public Library: Content in the Public Library is created by us and provided on an "as-is" basis.

6. Data Storage and Retention

Your Generated Content and associated User Inputs are stored in your personal, private Apple CloudKit database associated with your iCloud account. We do not control this storage. Data is retained indefinitely unless you choose to delete it through your device settings for the App. Once you delete this data, it is permanently removed and cannot be recovered by us. You are responsible for managing your own data.

7. Third-Party Services

The Service relies on third-party AI models and APIs (e.g., for generative AI, speech-to-text, and text-to-speech). By using Kukulala, you agree to be bound by the applicable terms and policies of these providers. While these providers may change over time, your use of the Service must always comply with their fundamental content restrictions, which are incorporated into our Acceptable Use Policy below.

8. Acceptable Use Policy

You agree not to use the Service to create, upload, or generate any content that:

• Is illegal, hateful, harassing, abusive, defamatory, obscene, or sexually explicit.
• Depicts or promotes violence or self-harm.
• Infringes on any third party's intellectual property rights, including copyright and trademark.
• Violates any individual's right to privacy or publicity.
• Attempts to discover the source code of the App or its underlying components.

9. Our Intellectual Property

All rights, title, and interest in and to the Service itself—including the application's design, software, branding, logos, and all content in the Public Library—are the exclusive property of Coralworks Innovations Inc. and its licensors.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for any violation of these Terms. You may terminate these Terms at any time by cancelling your subscription and ceasing to use the App.

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CORALWORKS INNOVATIONS INC. AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE TOTAL AMOUNT YOU PAID US IN SUBSCRIPTION FEES DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Toronto, Ontario, and the parties irrevocably consent to the personal jurisdiction and venue therein.

13. Changes to Terms

We may modify these Terms from time to time. If we make material changes, we will provide you with reasonable notice, such as through an in-app notification. Your continued use of the Service after such notice constitutes your acceptance of the revised Terms.
